I don't think it was the rule, just terrible application of the rule.  As Rottino said,  you have 3 feet on each side of "the baseline" which is undefined anyway... costs the Brewers a run.  Umps always let a guy avoid a tag within reason....this one wasn't even close to egregious...just a quick sidestep.

Ortiz bunt to first base. The pitcher fielded and tried to tag (missed), Ortiz altered his running path but did not go three feet out of the path. Called out anyway. Papa Murphy argued and tossed.
