The answer is that the Brewers don't need to take him off yet. They have only 39 on the 40 right now. I would expect Richie to be dropped at the end of the season to make room for some prospects. But your right, he's done nothing to deserve being on the 40.

I'll guess that it was between the Brewers and a couple of other teams that he was considering signing with at the beginning of the season and agreed to the Brewers because they offered a 40 man spot where others didn't. He certainly has not done much to hold onto it though.

Gardner was claimed off waivers from the Reds at the end of spring training, used to be a top prospect of theirs, and the need hasn't arisen to take him off yet.
