  1. I'm not even a Badger Football fan but I love Matt Lepay's enthusiastic touchdown call.
  2. The "actual malice" standard refers to Jack Clark's state of mind with respect to the truth or falsity of the statement. Basically, he can only be held liable if he made it up out of thin air without any evidence or facts on which he relied, no matter how flimsy. If Clark heard a rumor from someone who he believed was telling the truth, that would be enough to avoid a claim of actual malice and, therefore, a claim of defamation.
  3. The discovery on this case should be interesting. A lot of things can come out of discovery in a defamation case, particularly where both sides have a lot of money to seek the production of e-mails and obtain sworn testimony under oath in depositions. A lot of times, the party filing the case comes to regret it, especially when the attorneys start justifiably delving into their private communications. Considering Pujols is a public figure, this case will be really hard to prove. He will have to show that Jack Clark acted with actual malice in making the statement. In other words, Pujols will have to prove that Jack Clark knew the falsity of the statement or acted with reckless disregard of the truth. This is very very difficult. Pujols, who has more money than he knows what to do with, is likely hoping to make a quick strike to convince Jack Clark that he would rather retract and apologize than pay the legal defense costs.
  4. I thought this was a good article that touches on the Gomez-McCann confrontation. http://www.sportsonearth.com/article/62352290/ The author's point is that the so-called unwritten rules of the game are changing (or should be) due the growing Latino presence in the major leagues. Personally, I enjoy a little bit of flash. It adds something to the game. I don't view those who feel otherwise with contempt or anything. I just get tired of the "Guardians of the Game" taking the unwritten rules so seriously as to punish any individuality in the game.
  5. While I have every reason to now believe that Braun used PED's for several years, it is far to early to place much credibility on this guy's lawsuit. First, anyone can say almost anything they like in filing a lawsuit and be protected from libel claims. Remember, these are only accusations. Second, this Sasson guy claims to be a law student who Braun orally retained to perform background research on the sample collector for $5,000.00. This is not credible. Internet-based legal research on a guy's background does not cost $5,000.00, even when you are using high-priced lawfirms. Most private investigators conducting internet-based research charge $500.00, not $5,000.00. Besides, why would Braun hire a non-licensed law student when he has millions of dollars and capable lawyers representing him? EDITED: I see by looking at Milwaukee County records that the Defamation suit has been filed. You can't access the document on-line that I can tell.
  6. 2 @ Phi 2-0 3 vs Oak 2-1 4 vs Phi 2-2 3 @ Mia 2-1 3 @ Cin 1-2 3 @ Hou 2-1 3 vs Atl 1-2 3 vs Chi 2-1 3 @ Pit 2-1 16-11
  7. BuckyBrewer, this team cannot be as bad as those early 70s teams, can it? I remember that '87 team, they started the year with 13 straight wins and followed it up with 12 straight losses in May. What a team that was!
  8. I don't see how the FSN girls are sexist. Ladies watching the games have gotten years of enjoying the sexiest men alive in Jerry Augustine and Bill Schroeder. It's time for us guys to finally have some eye candy to look at...
  9. That is Terrible News with Capital Letters!!! I guess it's Taylor Green's time to shine. The Good News is that the hole at 1B will not be for the whole year anyway since Corey Hart should be back by May(?)
  10. I got to listen to an inning this afternoon during lunch. He was pretty good describing the action. Joe was also talking about the fact that 100 years ago today, the Yankees (then known as the Highlanders) wore their pinstripes for the first time. I enjoyed hearing this most trivial of trivia.
  11. Wild cow. My wife and I ate there when we took a vacation to Nashville last year. They have a picture of Prince to mark the mens room. Good vegetarian food.
  12. Some lines on this thread have gotten absurd. Lets turn the whole thread over to pebadger and let the rest of this stupid speculation end.
  13. 2011 .253 8 49 .298 Career .262 22 126 .304BA/HR/RBI/OBP: Ian Desmond would be a major downgrade from Yuni B at the plate. He was atrocious this year. Additionally, he has had 57 errors over the last two seasons according to Baseball Reference
  14. "Counsell and Kotsay beat Cordero in bottom of 9th, 2nd time in 3 games" Aside from the Braun Home Run the other night and hearing Uecker call the final strikeout, I think this was my personal favorite of the season.
  15. Monday night in the 200 level!!! Can't wait.
  16. In fact, Baseball Prospectus says there is an approximately 3.1% chance of someone other than the Brewers or Cardinals winning the division.
  17. That was terrific! It's funny because it's true (well almost true)
  18. I have heard the same thing from people I know that work for the Brewers or work with the Brewers. He has also always been gracious when I've seen him at dinner with family or friends at the restaurant.
  19. I really don't pay attention much to the AL because I really enjoy the NL style of baseball a lot more. The DH seems artificial to me. I guess if I had to choose, it would be the White Sox since I live in the SW suburbs of Chicago and there are a fair amount of White Sox fans around who get pretty excited about the team. The thing I like about the White Sox is their attempts to reach out to the community. For example, when my second son was born, the White Sox gave us four tickets to a game just because. Additionally, they put on a very good one week skills camp for kids who are just learning to play baseball. You don't see the Cubs do community outreach the same way you see the Sox do it. Also, US Cellular is not a bad stadium to take your kids to a game (as long as it's not a Friday or Saturday night.)
  20. I see that the Superbowl trophy(ies) are in Marquette Michigan tonight. See this link.
  21. I don't have a problem with fans booing the repeated throws over to first base. I understand it is part of the game, but it is an annoying part of the game that impedes the flow of the game. (Of course, that's the point.) It sure beats some of the other reasons fans find to boo such as the decision by some fans over the weekend to boo Billy Hall and Carlos Lee while the Astros were in town.
  22. I can't believe I fell for this. I was even looking out for April Fools stuff and this one got me. Alarm bells should have gone off when you "quoted" Melvin as discussing a deal before it was done.
