  2. Brewerfan.net defeats SOB III 16-13. Win dedicated to Steve Barritt. 3. Also, I think a full investigation was done 3 months ago when the this issue cropped up. The family sued, but I wanted to point out in the update that they have since dropped their lawsuit. I can only presume that their lawyers were unable to make any headway in attempting to prove negligence. It was dropped against all three entities as well, inlcuding the dispatcher, the police department, and the City of Madison. Given the recent events with my Dad, I know that I wouldn't just drop the suit just to drop it and not deal with it anymore and presumably this family wouldn't either. I can only therefore assume, as I've stated in previous posts that the lawsuit was very unlikely to be successful and their lawyers finally realized it or were finally able to convince the parents of such.
  4. I think it is the counterintelligence people on the show "24'
  5. The track has again shifted just slightly to the east, putting landfall around Tampa perhaps. Earlier it was just bit more north before slicing east, say Ocala area. The reason Sarasota/Tampa keep dodging storms is because it is very difficult to get one here. This is the only real possible way to get a good hurricane hitting in that it must come into the gulf, stall, and then go back east. Anything slamming Miami and continuing across is worthless. Most of the high mountains and elevation of Cuba is in eastern Cuba and this little jaunt acorss Cuba won't weaken Fay very much. I also am going to guess a small Category 1 with winds at 74mph and landfall at Port Charlotte.
  6. This absolutely sucks. As a fan of mass chaos, surely the hurricane season after I leave the area suddenly is in the dead rights of a small scale hurricane. All you Florida peoples stay safe! www.nhc.noaa.gov
  7. Astros have just lost Carlos Lee for the season as well, that has to hurt a bit.

  9. Updating; The family of the Madison girl is dropping their federal lawsuit against the dispatcher, Madison PD, and the City of Madison, WI. Presumably at the recommedation of their lawyer. Link: http://www.wsaw.com/brittanyzimmermann/headlines/26005264.html The court documents are also available at the top of the linked page.
  10. Quarterbacks who can't fight their way out of a paper bag.
  11. Yeah, Cameron is notorious for being out last or near last. Gagne is usually gone within 5-8 minutes of the last pitch.
  12. I can't remember what line of work you are in brewers19, but that seems a little extreme. Most employers have a sliding scale for discipline. I don't even know what to call this, insubordination (if they told him to calm it down and obviously he didnt) Most first offenses for insubordination range from warning to 1 week suspension (as a police officer it was 1 week susp.) That said, we don't know TH's history of discipline, so it's tough to gauge the right amount of discipline he should receive. I dont want to make a ethnic reference, but here's hoping your bosses are ruling with Hitler type authority. Disclaimer: Mods, please just delete this if that was inappopriate, I can't afford another strike, yet couldn't get my point across otherwise. If I offend anybody's German heritage by referencing Adolf Hitler, I apologize in advance.
  13. CC has. Most notably off the top of my head was after the National game with the Kapler walkoff dinger. Ted Simmons I can't confirm nor deny as I haven't paid attention to him specifically on any occassion.
  14. Much agreed JJ Hardy7, I guess maybe using a crminal's name wasn't the exact point I was getting at. I was simply trying to find the "most negative" context that I could. Here's a different example. Somebody that is a "person of interest in a case" but not arrested or somebody who does negatively in a ball game, or somebody who does negatively in a community act. Simply because the press is negative press doesn't sudddenly proclude the press from using your name in a publication. Am I more clear that way? I also don't think that Tom Haudricort saying the fella had "hurt feelings" neccessarily makes the statement a false statement and satisfies element #1 of defamation of character. On the other hand, I am going to backtrack a little bit and post the following from the privacy policy when you sign up for an interactive account at JSonline.com Except as stated in this privacy policy or at the time of collection, a user's personally identifiable information will not be transferred to a party outside Journal Interactive and Journal Sentinel Inc., its divisions or affiliates, or its service vendors unless notice is given at the time of collection or prior to transfer. OnWisconsin.com and JSOnline.com may also disclose account information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our User Agreement or may be causing injury to or interference with (either intentionally or unintentionally) OnWisconsin.com and JSOnline.com's rights or property, other OnWisconsin.com and JSOnline.com users, or anyone else that could be harmed by such activities. The 2nd half of that is up for open intrepretation I guess. Two lawyers would have fun arguing that. But I also agree that it would be frivilous and a waste of time. Any lawsuit though would seemingly lie with Haudricort and not the JS, as it appears they were prudent in making TH seemingly remove the information promptly.
  15. Your name is also not a matter of privacy. Such as criminals or those arrested can't complain that their name is the paper. Obviously that situation isn't positive press as is this situation wasn't positive press, so I don't see the basis at all for a civil lawsuit. My specialty is criminal law, but I dabble some in civil law and I'm just not seeing it here. Again, I disagree and think it's highly unprofessional, but not lawsuit material.
  16. No Way! While it was unprofessional, there is in no way a case for defamation of character here. Here are the elements to defamation of character, all which must be present. Defamation is the issuance of a false statement about another person, which causes that person to suffer harm. Slander involves the making of defamatory statements by a transitory (non-fixed) representation, usually an oral (spoken) representation. Libel involves the making of defamatory statements in a fixed or medium, such as a magazine or newspaper. The elements of a cause of action for defamation are: 1. A false and defamatory statement concerning another; (the biggest one, nothing appears false in the statement made by Haudricort) 2. The unprivileged publication of the statement to a third party; (yes) 3. If the defamatory matter is of public concern, fault amounting at least to negligence on the part of the publisher; and (maybe, JS does not appear to edit these things and the negligence may lie with Haudricort only and not the Journal Sentinel.) 4. Damage to the plaintiff. (pretty hard to quantify) So while the elements may be met for #2 and #3, and loosely at that, certainly #1 isn't met as the statements aren't false as we know them. Certainly this Adam fella did the action being accussed by Haudricort. Simply publicizing somebody's email address is not a matter of libel. There may be another issue or privacy in regards to the giving out of an email address, but it has already been ruled by the Supreme Court that an email address is not a matter of personal privacy. It is not privileged information such as a date of birth, social security number, medical information, home address, etc. So while unprofessional, this is a far cry for a lawsuit, especially not against the JS.
  17. I think this is too broad of a generalization to say nobody and anymore. On days that I am working after the game and have to supervise and assist security and ushers with escorting players and the players lot, I've seen plenty of the players signing lately. Cameron, Hall, Kapler, Hardy, Weeks, Fielder...I've seen just about every man of the 25 man roster sign atleast once during the last homestand. The collectors have also diminished significantly. Probably 5-7 collectors, 15 adults and 15 kids on a typical night game.
  18. I heard that gal couldn't get a word in edge-wise between the slurred "you knows". Then her real boyfriend showed up and a fight ensued. He probably could've gotten the better of the dude in the fight, but he swung and missed.
  19. Even so, an umpire's schedule is so grueling that it's not about desire to follow a team as much as it is actual time to do so. Sure, you can check box scores a few nights, but I certainly have encountered the 'I don't even have time to follow the/my team' from people that work in baseball. I'd venture to guess that about 80% of those people weren't being completely honest, for one reason or another. If you are in baseball, it's because you like baseball, whether it be the front office, an umpire, or working in concessions. Now certainly there are a few office girls who may not care two cents about baseball but have a nice administrative assistant job. However, with tivo today and MLB.tv, etc Sheethead is right, "Everybody has a team".
  20. And if you don't like the product on the field, don't watch it. They most certainly go hand in hand and that's just downright hypocritical. It's a discussion just like anything else. Maybe it belongs the off-topic area, but it certainly isn't a waste of a discussion simply because one can choose not to read the newspaper.
  21. Nice avatar, but can you merge a shot of a Weeks in there as well. OBP and AVG are almost identical?
  22. Foxsports.com Senior Baseball Analyst, Ken Rosenthal has just stated that the Brewers chemistry is no better and that the talent level isn't really that good and that they are picking on a weak schedule. This is kind of surprising considering I thought Rosenthal was always talking up the Brewers and had them picked in his pre-season prognastications. Are the Brewers really just picking on the weak schedule or are we the 2nd most talented team in the NL? A link to the video below. A little more than a jab to the gut was my impression. http://video.msn.com/video.aspx?mkt=en-us&brand=foxsports&vid=fd48b814-d86e-488b-85c5-7b54856b2a06&playlist=&editor=&from=FOXSPORTS&fg=/mlb&rf=http://msn.foxsports.com/mlb
  23. No offense TLB, but it is the vent thread. Geesh, I love you TLB, but take a breather.
  24. Found out that season ticket holders will be receiving invoices for playoff tickets any day now. As a long time season ticket holder, I can't believe I'm saying this, but I am not planning on sending a check in for playoff tickets. I don't see the playoffs for this team, and I don't want the Brewers to sit on my dollars (I'm assuming the price per seat will be more than regular season). I'm not sure this is my wisest decision, but it's how I feel. How about other season tickets holders here; what are you going to do? ~~~Pedro in 2007 Any what are your plans this year Pedro? And everybody else
  25. Well...this is a forum board. If that were the case, couldn't every discussion/complaint on here be, just do "x" or just stop paying attention to "x" and problem solved?
