    Disagree. He took the case brought to him. Lawyers don't decide to sue people, people do. Its like saying doctors are the cause of death. You can feel free to sue on your own if you want to, no lawyer required. People thinking they are entitled to recover for every little slight are the problem. Don't blame the system.

    I fail to see how sliming FTJ helps make your point, or any point for that matter. Its like trying to win an argument by shouting "You're an idiot!" at the top of you lungs. After reviewing the MO statute (I am not licensed in that state) it appears that the suit gainst the bar owner will go nowhere. There may be some wiggle room to include a server in the suit, and I could make a long and boring argument that the statute contradicts itself but it probably wouldn't work in court. Strange that MO will let you get as drunk as you want and the bartender can help you to your car after serving you 20 shots of tequila and have no responsibility. Hancock is burdened by personal responsibility but the batender isn't? As for the seeming shotgun approach by suing everyone here, well, you have to. The rules of Civil Procedure say that you need to join everybody onvovled in the same suit or forever lose a right of recovery against them. In other words, you can't try the bat, and then the Geo driver, and then the tow truck driver. You have to go after them all at once.

    Palsgraf v. LIRR Alrighty, tort class time. There is a proximate cause to everything and yes you do have to draw the line somewhere. The key word here is reasonably foreseeable consequences. Is the case repugnant? Sure, when you are looking at it as a complete outsider with no knowledge of the facts. I'm sure this will be all over talk radio tomorrow and we can all get lathered up and outraged. Buuuut, what about that Geo driver? Were they drunk and stopped by the side to take a whiz and broke down? Did they have a license? Were they driving without insurance? Did the tow truck driver follow proper procedure for that stretch of road? I'm not saying any of these things happend. Most likely Hancock is almost solely to blame and his estate will get bubkis. But we KNOW nothing, just assume.

    First off, I don't take these kind of cases. Second, we don't know all the facts. We haven't seen the police reports, the interviews with bartenders, the truck driver, etc. So, lets hold off before condemning someone as the scum of the earth. Most states do have what is called a dram shop law. Basically, a tavern owner cannot serve an intoxicated person. If they do, they are considered PARTIALLY negligent. Do you think a tavern owner is going to voluntarily admit that they overserved a guy? Nope, thus the lawsuit. As for the other parties if there is no reason for them to be in the suit, they will be dismissed. If the lawyer who brought the case didn't have any reason to do so, he/she can be punished (yes it does happen cynics). Do I like this suit? No. But if Dad has been asking questions and not getting any straight answers, it is within his right to bring suit. If people always told the truth or always did what they contract to do, there would be no need for the legal system. EDIT: Hawing, to respond to your question, some form of negligence on behalf of the stalled driver is possible. If that stretch of road lacks a left hand shoulder, and they had the opportunity to get over before stopping, they may have created a dangerous situation. No, they would not be 100% liable, but some percentage could be attributed to them

    I'm a big Pollack fan, even if some folks think it looks like he sneezed paint on canvas. Art is in the eye of the beholder. Some folks like Dogs Playing Poker or black light Led Zep posters. I will admit to having one of those.

The line up Larussa and I wrote on a beer coaster last night: 2B Weeks CF TGJ SS Hardy 1B Prince LF Jenks RF Hart C Miller 3B Graffy P Sheets Speculative I know. Jenks has earned a start aginst lefties, and I want to see how Gwynn handles them as a starter. That and Mench has earned nothing. Hall was left out on splits only, but if he plays center, I'd drop him to 6th. My first lineup ever. Lets see how wrong I am.

    My textured vent: 1. Get Weeks out of leadoff. Try Gwynn out. Yeah, I know, that complicates an already clogged outfield, but Weeks' popups and strikeouts are killing us. 2. Put Hardy at cleanup. He's raking, makes contact, and is hitting for power. Move Hall lower down so he can find his stroke again. Prince will see some pitches. If you think our best relief pitcher should be used more often regardless of situation, you should have no problem with your best hitter batting cleanup. 3. Fire Wynegar, again. That is all.

    Must wake up bats! Who stole the rum?! Offense has taken a 3 day vacation. Lets get a move on. Also, again, if Mench and Estrada are in the lineup, they need to be away from one another. Otherwise, the Phils will ahve 2 or 3 6 pitch innings.

    First off, what am I going to do Thursday with no in game thread? Second, Ray King is the man. Me my bro and some friends saw him in Cincy the last year of Riverfront, 2002. It was the game where Alex Sanchez broke himself. Anyhoo, we were first row in right field overlooking the Brewer's pen. When Ray was walking out to the pen before the game, we all stood up, cheered, and waived our Brewers gear at him. He came over stood at the base of the wall thanked us for coming, asked us where we were from, and shot the breeze for a couple of minutes. I will always have a spot for Ray King. The Brewers won that game, one of only 56 that year. We almost got killed singing "Roll Out the Barrel" on the concourse outside Riverfront. Something about talking smack when your team stinks...

I'm going to be there with my Dad and 2 brothers, one of whom I haven't seen in 13 months because he has been quite literally living in Siberia. The throat singing group Alash, which my bro manages, will also be in attendance. If you see 5 Mongolian looking dudes with a tiny white woman (Mom) say hi. They don't speak much English, but they will say hi back.

    I was unaware I had found you. I was referring to an earlier thread about our own Ann Carrol. Somebody said she was supposed to be an Andrews knockoff. I was saying that can't be true because Andrews looks like she eats.
